These Terms and Conditions govern the 776BC Performance Pack Competition (Competition). Information on how to enter and prize details published on the official entry page for the relevant regatta event (Event) form part of these Terms and Conditions. Participation in this Competition constitutes acceptance of these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid.
The Promoter is 776BC International Pty Ltd (Promoter).
For the purposes of this New Zealand promotion, the Promoter conducts this Competition in accordance with New Zealand law.
2.1 Entry is open to residents of New Zealand.
2.2 Entrants under the age of 18 years must have the consent of a parent or legal guardian to enter the Competition.
2.3 By entering, entrants under 18 warrant that they have obtained such consent.
2.4 The Promoter reserves the right to request evidence of parental or guardian consent at any time and may disqualify an entrant if such consent cannot be verified.
2.5 Employees (and their immediate families) of the Promoter and agencies associated with this Competition are ineligible to enter.
2.6 Immediate family includes spouse, partner, child, parent, sibling or any person living in the same household.
3.1 To enter, eligible individuals must complete and submit the official Entry Form available via the 776BC Competition entry page for the relevant Event.
3.2 Submission of a completed Entry Form constitutes one (1) entry.
3.3 Limit of one (1) entry per person unless otherwise specified on the official Competition entry page.
3.4 Entries must be received during the Competition Period. The Promoter is not responsible for entries not received due to technical malfunction, network failure or other causes beyond its reasonable control.
4.1 The Competition commences and closes at the times specified on the official 776BC Competition entry page for the relevant Event (Competition Period).
4.2 The Promoter reserves the right to amend or extend the Competition Period where reasonably necessary.
5.1 This Competition is a free-to-enter sales promotion scheme conducted in accordance with the Gambling Act 2003 (NZ).
5.2 This Competition is a game of chance. Skill plays no part in determining the winner.
5.3 No purchase or payment is required to enter or win.
6.1 One (1) winner will be selected.
6.2 At the conclusion of the Competition Period, one (1) valid entry will be drawn at random.
6.3 The draw will take place within fourteen (14) days of the end of the Competition Period.
6.4 The draw will be conducted electronically using a random selection process.
6.5 The winner (Winner) will be notified privately via email within seven (7) days of the draw.
6.6 The Winner’s details will not be published unless required by law.
7.1 The Winner will receive one (1) 776BC Performance Pack consisting of:
One (1) unisuit
One (1) base layer
One (1) pair of socks
Total maximum prize pool value: RRP NZD equivalent of AUD $248 (inclusive of GST), as determined by the Promoter at the time of award.
7.2 The Prize will be supplied within forty-five (45) days of the draw.
7.3 The Prize:
Is not transferable;
Is not exchangeable;
Cannot be redeemed for cash; and
Must be used for personal use only.
7.4 If the Prize becomes unavailable, the Promoter reserves the right to substitute it with a prize of equal or greater value.
8.1 If the Winner cannot be contacted or does not claim the Prize within thirty (30) days of notification, the Prize will be forfeited.
8.2 The Promoter reserves the right to redraw and award the Prize to an alternate winner.
9.1 The Promoter reserves the right to verify the validity of entries and entrants.
9.2 The Promoter may disqualify any entrant who:
Breaches these Terms and Conditions;
Tampers with the entry process; or
Engages in misleading or deceptive conduct.
10.1 Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Consumer Guarantees Act 1993 (NZ) or any other applicable law that cannot lawfully be excluded.
10.2 Subject to clause 10.1, the Promoter excludes all liability for loss or damage arising from participation in the Competition or use of the Prize.
11.1 Personal information provided by entrants will be collected, stored and used in accordance with the Privacy Act 2020 (NZ).
11.2 Information will be used for:
Administering the Competition;
Contacting the Winner;
Delivering the Prize; and
Marketing communications (unless the entrant opts out).
11.3 Entrants have the right to access and request correction of their personal information.
11.4 Where an entrant is under 18 years of age, personal information may be provided by a parent or guardian on their behalf.
These Terms and Conditions are governed by the laws of New Zealand.
