Terms and Conditions (United Kingdom)

These Terms and Conditions govern the 776BC Performance Pack Prize Draw (Prize Draw), an ongoing prize draw programme operated by the Promoter across multiple regatta events (each, an Event). Information on how to enter and prize details published on the official entry page for each Event form part of these Terms and Conditions. Participation in this Prize Draw constitutes acceptance of these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid.
This is a free prize draw. No purchase is necessary to enter or win.
The Promoter is 776BC UK Ltd of 100 Bollo Lane, C/O Paul Beare Ltd, London, W4 5LX, United Kingdom (Promoter).

2.1 The Prize Draw is an ongoing programme. Each Event listed in the Event Schedule (Section 13) has its own Entry Period and is drawn independently.
2.2 One (1) Winner is drawn per Event. Entry into one Event does not carry over to any other Event.
2.3 The Prize for every Event is the same: one (1) 776BC Performance Pack with an RRP of £160 GBP (inclusive of VAT). Full Prize details are set out in clause 9.
2.4 The Promoter may add new Events to the Event Schedule at any time. New Events will be listed in the updated Event Schedule and published on the Promoter's website prior to the new Event's Entry Period opening.
2.5 Once an Event has been listed in the Event Schedule with a closing date, the Promoter will not retrospectively change the closing date, the Prize, or the eligibility criteria for that Event in a way that disadvantages entrants.
2.6 The Promoter reserves the right to close the Prize Draw programme as a whole at any time on no less than thirty (30) days' notice published on the Promoter's website, provided that any Event with an open Entry Period at the time of such notice will be honoured and drawn in accordance with these Terms and Conditions.
3.1 Entry is open to residents of the United Kingdom only.
3.2 Entrants under the age of 18 years must have the consent of a parent or legal guardian to enter the Prize Draw.
3.3 By entering the Prize Draw, entrants under 18 years of age warrant that they have obtained the consent of a parent or legal guardian. Where an entrant is under 18, the parent or legal guardian is deemed to have read, understood and accepted these Terms and Conditions on the entrant's behalf.
3.4 The Promoter reserves the right to request written evidence of parental or guardian consent at any time and may disqualify an entrant or withhold a Prize if such consent cannot be verified to the Promoter's reasonable satisfaction.
3.5 Where the Winner is under 18, the Promoter will liaise directly with the Winner's parent or legal guardian in relation to Prize notification, claim and delivery.
3.6 Employees (and their immediate families) of the Promoter, its parent and group companies, participating retailers and agencies professionally associated with this Prize Draw are ineligible to enter.
3.7 Immediate family means: spouse, civil partner, ex-spouse, ex-civil partner, partner, child or step-child (natural or by adoption), parent, step-parent, grandparent, step-grandparent, sibling, step-sibling, uncle, aunt, niece, nephew or first cousin.
4.1 To enter, eligible individuals must complete and submit the official Entry Form available via the 776BC Prize Draw entry page for the relevant Event.
4.2 Submission of a completed Entry Form constitutes one (1) entry (Entry).
4.3 Limit of one (1) Entry per person per Event unless otherwise specified on the official Prize Draw entry page for that Event.
4.4 Entries must be received during the Entry Period for the relevant Event as set out in the Event Schedule. The Promoter is not responsible for any entries not received for any reason during an Entry Period, including technical malfunction, network failure or platform issues.
4.5 No purchase is necessary. Entry is free. Internet access and an email address are required to submit an Entry, and any associated costs are the entrant's responsibility.
5.1 An entry period (Entry Period) applies to each Event, with closing dates as set out in the Event Schedule (Section 13). All times are United Kingdom local time (GMT or BST as applicable).
5.2 The Promoter may extend an open Entry Period (but not shorten it once published) to the extent permitted by applicable law, where reasonably necessary.
5.3 The Promoter may add new Events with new Entry Periods at any time by updating the Event Schedule.
6.1 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including identity, age and place of residence) and to require an entrant (or their parent or legal guardian) to provide proof in a form acceptable to the Promoter.
6.2 The Promoter may disqualify any entrant who:
• Submits an entry not in accordance with these Terms and Conditions;
• Tampers with the entry process; or
• Engages in fraudulent, misleading or deceptive conduct.
6.3 Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any right does not constitute a waiver of that right.
6.4 Incomplete, indecipherable or illegible entries will be deemed invalid.
7.1 Entrants acknowledge and agree that their Entry must not be:
• Obscene, defamatory, libellous, threatening, harassing or hateful;
• Racially or ethnically offensive;
• Encouraging conduct that would constitute a criminal offence or give rise to civil liability; or
• In breach of any applicable law.
7.2 Each entrant warrants that they have the legal capacity to enter the Prize Draw. Where an entrant is under 18 years of age, a parent or legal guardian is deemed to have accepted these Terms and Conditions on the entrant's behalf.
7.3 To the extent permitted by law, entrants (and where applicable, their parent or legal guardian) agree to indemnify the Promoter against loss arising from a breach of these Terms and Conditions.
8.1 One (1) Winner will be selected per Event.
8.2 At the conclusion of each Event's Entry Period, one (1) valid Entry will be drawn at random from all eligible entries received for that Event.
8.3 This Prize Draw is a game of chance. Skill plays no part in determining the Winner.
8.4 Each draw will take place within fourteen (14) days of the end of the relevant Event's Entry Period.
8.5 The draw will be conducted electronically using a random selection process under the supervision of an independent person.
8.6 The Winner (Winner) will be notified privately via email from info@776bc.com within seven (7) days of the draw. Where the Winner is under 18, notification will be addressed to their parent or legal guardian using the contact details provided at entry.
8.7 In accordance with CAP Code requirements, the surname and county of each Winner will be available on request by writing to the Promoter at the address in clause 1 within two (2) months of the relevant draw date. Entrants (or their parent or legal guardian) may request that this information be withheld, save where the Promoter is required by law to provide it.
9.1 The Prize for each Event is one (1) 776BC Performance Pack consisting of:
• One (1) unisuit (RRP £80 inc. VAT);
• One (1) base layer (RRP £60 inc. VAT); and
• One (1) pair of socks (RRP £20 inc. VAT).
Total Prize value per Event: RRP £160 GBP (inclusive of VAT).
9.2 The Prize will be supplied within forty-five (45) days of the draw, to a UK delivery address provided by the Winner (or their parent or legal guardian).
9.3 The Prize must be taken as stated and:
• Is not transferable (unless agreed by the Promoter);
• Is not exchangeable for other goods or services;
• Cannot be redeemed for cash; and
• Must be used for personal use only and must not be resold or auctioned without prior written consent of the Promoter.
9.4 If the Prize becomes unavailable for reasons beyond the Promoter's reasonable control, the Promoter reserves the right to substitute it with a prize of equal or greater value.
10.1 If the Winner (or their parent or legal guardian, where applicable) is not contactable or does not claim the Prize within thirty (30) days of notification, the Promoter reserves the right to forfeit the Prize and conduct a redraw.
10.2 The Promoter will make reasonable efforts to contact the Winner before any forfeiture or redraw.
11.1 If the Prize Draw is interfered with in any way or is not capable of being conducted as reasonably anticipated due to circumstances beyond the Promoter's reasonable control, the Promoter reserves the right, to the fullest extent permitted by law, to:
• Disqualify any entrant; or
• Modify, suspend, terminate or cancel the Prize Draw or any Event within it.
11.2 Any cost associated with accessing the entry form is the entrant's responsibility and dependent on their internet service provider.
11.3 The use of automated entry software or other mechanical or electronic means that allows repeated automatic entries is prohibited and will render entries invalid.
11.4 Nothing in these Terms and Conditions limits or excludes the Promoter's liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded by applicable law.
11.5 Subject to clause 11.4, the Promoter (including its officers, employees and agents) excludes all liability (including in negligence) for any indirect, special or consequential loss, or loss of opportunity, arising in any way out of the Prize Draw or the use of the Prize.
11.6 The Promoter is not liable for delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, war, fire, flood, earthquake, strike, sickness, pandemic, accident or civil commotion.
12.1 The Promoter is the data controller for the purposes of UK GDPR and the Data Protection Act 2018 in respect of personal information provided by entrants in connection with this Prize Draw.
12.2 The personal information collected from entrants is: first name, last name, email address, country of residence, and (on an optional basis) phone number. Where the entrant is under 18, the name and email address of a parent or legal guardian will also be collected. This personal information will be used for the purposes of administering the Prize Draw, including:
• Verifying eligibility;
• Notifying the Winner;
• Contacting the Winner (or their parent or legal guardian) regarding Prize delivery;
• Delivering the Prize; and
• Complying with the Promoter's legal obligations.
12.3 The lawful basis for processing personal information for the purposes set out in clause 12.2 is the performance of the contract formed by these Terms and Conditions on entry, and the Promoter's legitimate interests in administering the Prize Draw.
12.4 The Promoter may also use personal information (including email address and, where provided, phone number) for direct marketing purposes via email and SMS. Marketing communications will only be sent where the entrant (or their parent or legal guardian, where applicable) has provided separate, specific consent for the relevant channel at the point of entry. Consent for email marketing and SMS marketing is captured separately and either may be withdrawn at any time without affecting the entrant's participation in the Prize Draw.
12.5 Where an entrant is under 18 years of age, personal information may be provided by a parent or legal guardian on their behalf, and the Promoter may contact a parent or legal guardian to verify consent or confirm prize acceptance.
12.6 Personal information will be retained only for as long as necessary to administer the Prize Draw and to comply with applicable legal and regulatory obligations.
12.7 Entrants have rights under UK GDPR including the right to access, rectify, erase, restrict, object to processing of, and port their personal data, and the right to lodge a complaint with the Information Commissioner's Office (www.ico.org.uk).
12.8 The Promoter's Privacy Policy is available at: https://uk.776bc.com/pages/privacy-policy.
12.9 This Prize Draw is not sponsored, endorsed, administered by or associated with Instagram, TikTok, Facebook or any other social media platform. Any personal information provided via those platforms is subject to their respective privacy policies.
The following Events are governed by these Terms and Conditions. The Promoter may add new Events to this Schedule at any time. Once listed with a closing date, an Event's terms (closing date, prize, eligibility) will not be retrospectively changed in a way that disadvantages entrants.

14.1 The Promoter may update these Terms and Conditions from time to time, including (without limitation) to add new Events to the Event Schedule, to reflect changes in applicable law, or to clarify drafting.
14.2 The version date is shown at the top of this document. The current version is published at the URL set out in clause 13.
14.3 Each entrant is bound by the version of these Terms and Conditions in force at the time of their Entry. Subsequent updates will not retrospectively affect Entries already submitted for an Event with an open or closed Entry Period.
15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The parties irrevocably agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, save that consumers resident elsewhere in the United Kingdom retain the right to bring proceedings in the courts of their home jurisdiction where required by law.
